Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the BizRocket website, web application, and mobile applications. Please read them carefully.
At a glance
- By using BizRocket, you agree to these Terms and our Privacy Policy.
- BizRocket is B2B software for home service companies. Accounts are typically created by your employer; you must be authorized to use the Service.
- Your company is responsible for how it uses customer data, SMS, and email compliance. You must use the Service lawfully and not abuse the platform.
- AI features provide suggestions only—you must verify important information before relying on them.
- The Service is provided “as is,” with limitations on liability and dispute resolution as described below.
1. Agreement to terms
These Terms form a binding agreement between you and BizRocket (“we,” “us,” or “our”) regarding the Service, including:
- the marketing website at bizrocketapp.com;
- the web application at app.bizrocketapp.com; and
- the BizRocket iOS app (bundle ID:
com.sesjr94.BizRocket) and Android app (package:com.sesjr94.bizrocket).
If you use the Service on behalf of a company, you represent that you have authority to bind that company. In that case, “you” includes the company.
Your use of the Service is also subject to our Privacy Policy, which is incorporated by reference.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and authorized by your employer or service company to use a BizRocket account. The Service is intended for business use by home service and related field service companies, not for personal consumer use unrelated to a business account.
3. Account registration and security
Accounts are typically provisioned by a company administrator, not through open consumer self-registration in the mobile app. You are responsible for:
- maintaining the confidentiality of your login credentials;
- all activity that occurs under your account; and
- notifying your administrator and BizRocket promptly if you suspect unauthorized access.
We may suspend or terminate access if we reasonably believe your account has been compromised or is being misused.
4. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of applicable law;
- harass, threaten, or spam end customers or other users via SMS, email, or in-app communications;
- upload malicious code, probe or scan systems without authorization, or interfere with the integrity or performance of the Service;
- reverse engineer, decompile, or attempt to extract source code from the Service except where permitted by law;
- access the Service to build a competing product or scrape data without permission;
- misrepresent your identity or affiliation; or
- violate the privacy or intellectual property rights of others.
We may investigate violations and cooperate with law enforcement where appropriate.
5. Business customer relationship
BizRocket is offered as a subscription-based B2B SaaS product to service companies. Commercial terms—including pricing, free trials, billing cycles, upgrades, and cancellation—are between BizRocket and the company that subscribes, not individual technicians, unless otherwise agreed in writing.
Plans and pricing are published on our website. New companies may start with a 14-day free trial (no credit card required unless stated at signup). Subscriptions renew according to the plan selected unless cancelled. You may cancel anytime through your account or by contacting support@bizrocketapp.com; access continues through the end of the current billing period. Fees are generally non-refundable except where required by law or expressly stated in writing.
Individual users access the Service through their employer’s subscription. If your company’s subscription ends, your access may be disabled.
6. Mobile app and device requirements
The mobile app requires a compatible device, operating system, and network connection. It requests when-in-use location only (not background location), plus camera, photo library, notifications, and network access as described in our Privacy Policy. Microphone and audio recording are disabled in the app build.
Offline mode uses a local database (WatermelonDB) and a sync queue; changes upload when connectivity returns. You are responsible for device security (passcode, OS updates) on equipment you use for work.
App distribution is subject to Apple App Store and Google Play terms in addition to these Terms.
7. Customer data and privacy
Business customers enter and control data about their customers, employees, and jobs. Each company is responsible for:
- collecting personal information lawfully and with any required notices and consents;
- complying with laws applicable to their industry and communications (including TCPA, CAN-SPAM, and state privacy laws for SMS and email to end customers); and
- responding to end-customer privacy requests relating to data the company stores in BizRocket.
If you are a business customer or authorized user acting for a company, your company agrees that BizRocket is not responsible for your company’s compliance program. Your company will defend and indemnify BizRocket against claims, fines, or damages arising from your company’s (or your users’) collection or use of end-customer data, or from SMS/email sent without proper consent, unlawful content, or violation of TCPA, CAN-SPAM, or similar laws—except to the extent caused by BizRocket’s gross negligence or willful misconduct.
8. Intellectual property
BizRocket and its licensors own all rights in the Service, including software, branding, documentation, and design. Except for the limited rights expressly granted to use the Service, no rights are transferred to you.
Your company retains ownership of business data it submits (customer lists, job records, photos, etc.). You grant BizRocket a license to host, process, and display that data solely to provide and improve the Service as described in our Privacy Policy.
9. AI features disclaimer
BizRocket may offer AI-assisted chat and similar features. AI outputs may be incomplete, inaccurate, or outdated. AI does not provide legal, financial, safety, or professional trade advice.
You must independently verify AI suggestions before relying on them for scheduling, pricing, customer communications, or field work. You remain solely responsible for decisions and actions taken in your business.
10. Communications
We may send service-related emails or in-app messages about your account, security, or product updates. Through the Service, your company may send transactional email to end customers (confirmations, en route notices, job completed, estimates, invoices, reminders) via Resend. Automated SMS is used primarily for “on the way” / en route notifications via our send-sms function (Blooio).
Each business customer is solely responsible for obtaining and documenting consent required for marketing or automated texts, honoring opt-out requests, and avoiding prohibited content. Message and data rates may apply to SMS recipients.
11. Payments and invoices
Your company may create estimates and invoices, generate PDFs, and record payment method and status (cash, check, credit card, other) for jobs and invoices. Technicians can record payments received in the field without card processing.
Where enabled on your account, Stripe payment links and checkout may be used so customers pay invoices online; card processing is subject to Stripe’s terms. BizRocket does not store full card numbers.
BizRocket is not a bank or money transmitter. Subscription fees owed to BizRocket are separate from payments your company collects from its customers.
12. Third-party integrations
Optional integrations are provided by third parties subject to their own terms and privacy policies. BizRocket is not responsible for third-party services you enable. Current integrations include:
- Google Maps — maps, geocoding, and driving directions
- Stripe — invoice payment links and checkout (where enabled)
- Resend — transactional email (confirmations, invoices, reminders)
- Blooio — automated en route SMS via
send-sms - PDFMonkey — PDF generation for estimates and invoices (server-side)
Availability of integrations may change.
13. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that data will never be lost (though we use reasonable safeguards). Some jurisdictions do not allow certain disclaimers; in those cases, disclaimers apply to the fullest extent permitted by law.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIZROCKET AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) SUBSCRIPTION FEES PAID BY THE SUBSCRIBING COMPANY TO BIZROCKET FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100) FOR USERS WITHOUT A DIRECT PAID SUBSCRIPTION (SUCH AS INDIVIDUAL TECHNICIANS ACCESSING THROUGH AN EMPLOYER’S ACCOUNT).
These limitations apply whether liability is based on contract, tort, negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages.
15. Indemnification
You agree to defend, indemnify, and hold harmless BizRocket and its affiliates, officers, directors, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from:
- your misuse of the Service;
- your violation of these Terms or applicable law;
- content or data you submit, including customer communications sent without proper consent; or
- disputes between you and your customers or employer, except to the extent caused by BizRocket’s gross negligence or willful misconduct.
If your company has signed a separate written agreement with BizRocket (such as a master services agreement or order form), that agreement governs in the event of a conflict with these Terms for the subscribed company.
16. Termination
You may stop using the Service at any time. We may suspend or terminate access immediately if you breach these Terms, if required by law, or if necessary to protect the Service or other users.
Upon termination, your right to access the Service ends. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
Upon termination, company administrators may request a data export within 30 days by contacting support@bizrocketapp.com. We will delete or anonymize production account data within 90 days, except where retention is required by law or encrypted backups for up to 90 days.
17. Dispute resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Before filing a claim, you agree to contact us at shawn@bizrocketapp.com and allow 30 days to try to resolve the dispute informally.
Except where prohibited by law, exclusive jurisdiction and venue for disputes arising from these Terms or the Service shall be in the state or federal courts located in Broward County, Florida. Each party waives any objection to venue in those courts.
No class actions: Disputes must be brought individually, not as a plaintiff or class member in any class or representative proceeding, to the extent permitted by law.
18. Changes to terms
We may modify these Terms from time to time. We will post updated Terms on this page and update the “Last updated” date. If changes are material, we may provide additional notice through the Service or email. Continued use after the effective date constitutes acceptance of the revised Terms.
